The Power of Attorney Route — When You Need It

Maharashtra’s Leave & License registration normally captures the biometric of both parties. When an NRI landlord cannot be present, a Power of Attorney (POA) is the standard solution:

The NRI executes a POA in their country of residence, gets it attested by the Indian Embassy / Consulate (or apostilled), couriers it to India, and the POA holder gets it adjudicated/registered locally. The POA holder can then sign and complete biometric registration on the NRI’s behalf. For Bangalore agreements (e-stamp + notary, no biometric), a POA is usually not required.

TDS on Rent Paid to an NRI Landlord

This is the one rule every NRI landlord must know — and most miss it. When rent is paid to an NRI, the tenant is legally required to deduct TDS under Section 195 of the Income Tax Act before paying you.

TDS on rent to an NRI is generally 31.2% (30% + 4% cess) of the rent — not the 2%–10% that applies to resident landlords. The tenant must hold a TAN, deposit the TDS against your PAN, and file Form 27Q. You can claim this TDS back when filing your India tax return, and you may apply for a lower-deduction certificate from the Income Tax Department to reduce it.

Spell out clearly in the agreement that rent is paid to an NRI owner and that the tenant will deduct applicable TDS — it avoids disputes later. For the exact rate in your case, consult a chartered accountant.
